David DANIEL, born 1769, son of William O'DANIEL, mother not known, is named in his father's Will and left 1 shilling.
According to the Hart Family Papers, David DANIEL married Mary MULDOON who died before 1819. David and Mary had only daughters: Dorcus Rebecca DANIEL (died after 1821), Sarah Jane, Harriet Eleanor, Cynthia, Mary, and Artemisia.
In 1788 David witnessed a deed of a John O'DANIEL to William O'DANIEL in Lancaster County, later Kershaw County, South Carolina.

In a letter from David to his brother, Josiah, in 1809, David said his wife (Mary MULDOON) was a sister of John MULDOON, apparently they had been married since 1802. David requested an answer to his letter be addressed to the Chester County Court House.

David DANIEL was sued in 1816 in the York District Court of Common Pleas by Philip RAIFORD and Jesse DANIEL, executors of the Last Will and Testament of Josiah L. DANIEL. On Feb. 13, 1810, David DANIEL had borrowed $80.00 from Josiah L. DANIEL which he had neglected to repay. The suit is recorded in the York County, S. C., Court of Common Pleas Judgment Rolls, 1800-1839, No. 697. A letter was presented as evidence by the plaintiffs. The letter mentioned, above, starts off "Brother Josiah." Granted, this salutation could mean a lot of things but if you read his letter to Josiah then you come away with the general assessment they are brothers, as well as the fact that David does not give express concern for Lucretia's kids. His will was sworn in the Court of Ordinary for Chester District by the subscribing witnesses on 28 May 1832. Appraisers were Henry FERGUSON, Joseph FERGUSON, John RIVES & John PITTMAN, and the appraisement of his personal property, including five slaves, amounting to about $1800.00, was filed 5 June 1832.
David DANIEL died on 1 June 1832 in Chester County, South Carolina. The Charleston Observer printed his death notice on 9 June 1832: "Died in Chester, S. C., on the 1st inst., David Daniel, Esq. aged 63."
At the Estate sale on 18 December 1832, items were purchased by the widow, William HAYS, Joshua SWEAT, William WYLIE, Senr., Jesse ASHCRAFT, John L. DAVIS?, W. T. INGRAM, James WATSON, Jonathan DAVIS, Wm. WYLIE, James LEE, Hugh MONTGOMERY, Hugh DRENNEN, Esq., Joel ASHCRAFT, Thomas WYLIE, John CULP, Dr. Charles BOYD, C. S. CLINE, John POLK, Mrs. Harriet DENNIS, Nathaniel McCAMON, John MONTGOMERY, Jr., Joseph McELWAIN?, Lewis CHAMBERS, Patrick FITZ JEROL, Lewis HARDIN, Wylie PITTMAN, James KENMORE, John M? On 2 June 1834, James LEE made a return on the Estate from June 1833 to June 1834. The following paid receipts to the Estate: Peter WYLIE, Nancy McCRIGHT, Thomas W. FARIS, Sarah JONSON, Margrate KEFLEY?, Wm. BRANON, C CLINE, Elisha DUNLAP by C. CLINE, John MONTGOMERY, James MCRIGHT, Artimesiah DANIEL, Mathew McCANCE, Maryann DANIEL, Samuel KELSEY, Isac McFADDEN, Thomas McCULAR, Wm WYLIE, Wm T INGRAM, Sarah ROWEL, George BROWN, James WHITE, Wm MAFFET, R. G. MILS, Hyder A DOVE?, Adam WILIE, Joseph CROOK, John CANMORE, John G CARTER, James MCRIGHT Exor. of Robert MCRIGHT.
Another appraisal of the Estate was authorized to Joseph FERGUSON, Dura H. PITTMAN, Henry LEE & Jesse ASHCRAFT on 1 February 1839. Probably this reappraisal was necessitated by the death of his widow. (See deeds listed for Artemisia DANIEL). On 21 November 1840 bond of $2,585.00 was given by C S CLINE, Artemisia DANIEL and William WYLIE for James LEE, Executor of the Estate of David DANIEL. Wit: Susanna LEE, Nancy INGRIMA (sic). Subsequent bond was given by Reuben & Harriett DENNIS and by Cha S CLINE as Admr. of Estate of Mary POLK. The final payment to all heirs was made on 19th January 1842. The amount of $4,999.40 was divided four ways, with some adjustments for debts due the Estate, and paid to Arter Mesiah DANIEL ($1275.36), C. S. CLINE, R. DENIS and C. S. CLINE as Admr. of Mary POLK.

Mary MULDOON was a daughter of David and Mary MULDOON. She married David DANIEL, Esq. (1769-1832) of Chester County, South Carolina. Mary's father was an attorney who had "bailed "poor David" DANIEL out of trouble on numerous occasions.
Mary DANIEL was not named in the Will of her father, but her husband was named executor of the Will.

Available information indicates Golden was a son of Golden HENDRICK and Mattie Lou DANIEL, daughter of John A. DANIEL and Sarah J. FOLDS.
DISCUSSION: About 1903, Golden HENDRICK, born 1870, married second Mattie Lou DANIEL, daughter of John A. and Sarah J. Folds DANIEL. Their son, Golden, was born 14 April 1905.
In the 1910 census of Texas, Heard County, Georgia, Mattie, "M1 6 2 1", and her sister, Lena "Wd 4 4", live with their parents. Five grandchildren are I the household. Mattie's son, Golden, age 5, is in this household, but Mattie's husband is not. Everyone is shown as DANIEL, complicating surname assignments. In the same town, Golden DANIEL, age 4, is listed in the home of James THORNTON, a widower. James was an uncle to Golden HENDRICK, having been married to Mattie's sisters, Sarah J. and Lee, both deceased by 1910. Was Golden simply listed twice in the two households, in one as 4, the other 5, because he was sharing time in both households?
When did Golden HENDRICK become a THORNTON? In 1920, Golden , now THORNTON, 14, resides with his uncle James THORNTON in Heard County. About 1922, Golden THORNTON married his cousin Dovie DANIEL, daughter of Robert Franklin DANIEL and Rachel Anna BRAND.
Between 1920 and 1930 Golden started using the name Henry THORNTON, so listed in the 1930 census with Dovie and children as well as on his death record and his headstone in Salem Methodist Church Cemetery in Heard County.
For all of the questions and possibilities here, the answer seems to be there was only one Golden HENDRICKS erroneously enumerated as DANIEL in 1910 and later either adopted by James THORNTON or took the name THORNTON after 1910. More information is needed..

*A census problem here? Parthenia was E. Y.'s wife, who should have been 42, but is not accounted for in this family entry. The initial "H." is as indexed at labs.familysearch.org and appears to be correct as viewed on the census page, but why "H."? In addition, E. Y. and Parthenia's 5 year old daughter, Hattie, born in 1875 and died in 1946, is missing from the family. Might someone have confused the census scribe and the daughter Hattie somehow became the wife, "H.", listed at Parthenia's age 42? Deduced from the following comment by Jessica Sellers Lott, email, 15 Dec 2008:
"This is an error - I have often wondered why this census record shows that. I think it's just a typo. But I have also not been able to figure out why Hattie who would have been 5 by then is not showing unless she was staying with relatives?? However, I do know that Parthenia outlived EY. Neither ever remarried."
A Double Hanging

Lee Harris and Abe Mitchell Will Pay the Penalty.
June 7 is the date fixed for the hanging of LEE HARRIS and ABE MITCHELL, the self-confessed murderers who pleaded quilty in the criminal court last week to murdering Pleas Merriweather a few weeks ago.
Last winter and spring numerous complaints were reported to the police of reobberies and hold ups. In the latter part of January James E. Thornton was killed as he was returning from the city in his wagon tohis home in Ensley City, where he kept a grocery store. Harris and Mitchell confessed to killing him and robbing the wagon. Thornton attempted to draw his pistol, but his assailants were took quick for him and both the negroes fired and kiled him.
A few days afterward two ladies driving in a buggy were held up and robbed about 20 feet from where Thornton was killed. The negroes were very polite to the ladies and did not molest them, otherwise than by taking their money.
Shortly after Mr. E. Y. Daniel was shot and dangerously wounded. Mr. Daniel is a farmer and lives near East Lake, He was present yesterday at the hanging and seemed to enjoy the hanging fully as much as his assailants.
Mr. James Stiff was attacked by highway robbers while coming home from the Mary Lee furnace and made to give up what valuables he had in his possession.
Mr. J. U. M. Barnes was also assaulted one Sunday night by four negroes, who demanded some whisky. Mr. Barnes being a North Birmingham distiller. The demand being refused the gang opened fire upon him and it was by the merest chance that Mr. Barnes and his son escaped assassinantion.
In March Please Merriweather, a negro keeping a store on the Northside, was found dead in his store, being fearfully butchered up. Two men were also held up and robbed in the North Highlands about this time. These outrages, following so closely one on the other, that it was thought to be the work of one gang, but not one could obtain any clue. Finally the matter was taken up by Capt. J. B. Donelson, after all the others failed. A better man could not have been found, for if there is any one on the police force who has the tenacity, shrewdness, persistence, and keenness to ferret out and bring to light evel and evil doers, that man is Captain Donelson. Never too tired, lax or thrown off the scent, he like the Vidog and Lecog of France, never knows a such a thing as fall and it was only a few days after he began his investigation before the murderers were safe behind the bars.
Harris and Mitchell were landed in jail on the 1st day of April, and on that same day they had made a full confession of all the crimes enumerated above. This confession was accompanied by such details that there could be no doubt of its authenticiy. The grand jury began its session on the following week and on the 17th of April they were brought out for trial. They were convicted on the 23d of the same month and were hanged yesterday. This is the quickest work in the history of the state.

James' father's will was proved 10 February 1845 in Lowndes County, Alabama. "At the death of my wife I direct that the negroes with their issues or increases be given to my following named children in manner as follows... To my son James I give Sally and Marcus...At Martha's death all other property to be equally divided between my children, Martha, James, Daniel, Edward, and Benjamin."

Phillip, V, served in Col. Taylor's regiment in the Revolutionary War, Captain Miles company, 61 days service. [Green, "History of Richland County."]
Phillip is likely one of the two males over 16 in his father's household in the 1790 census of Richland County, South Carolina lists a "Philip RAIFORD 1 2 6 - 11" [Series: M637 Roll: 11 Page: 163]
Philip married Elizabeth DANIEL about 1794. She was a daughter of William DANIEL and Lucretia BELL of Edgefield County, South Carolna. Between 1795 and 1816, Philip and Elizabeth had nine children.

On August 16, 1813, John, James, and Jesse DANIEL and Bryan MARSH released their claim in the real estate given to Phillip RAIFORD, husband of Elizabeth DANIEL, by the will of her father, William DANIEL.
The U.S. Census, 1820, for Edgefield County, South Carolina, page 178, lists Philip RAIFORD V's family as 3 1 0 1 0 1 - 1 0 1 1 0. Reads: 3 males under 10 [Robert, Malachi, Thomas Woodward], 1 male 10-16 [James M.], 1 male 16-26 [either Phillip, William or John D.], one male over 45 [Phillip]; 1 female under 10 [Elizabeth], one female 16-26 [Nancy], 1 female 26-45 [Elizabeth].
"Philip RAIFORD V resided in Edgefield County, South Carolina, where he died in 1824. His will was probated April 19, 1824. In his will his wife is not named, although we know from other sources that she was Elizabeth DANIEL, daughter of William DANIEL. This William DANIEL was apparently a very well to-do planter owning large, tracts of land in both Edgefield and Fairfield Counties, South Carolina. He died in 1807 leaving a will which mentions his daughter (Elizabeth RAIFORD). Philip's will mentions four "Elder children" Philip, William, John and Nancy and five "Minor children" Thomas, Robert, James, Malachi and Elizabeth. "I, Phillip RAIFORD, this being my last will and testament, first I desire that all my just debts to be paid from my estate before any gifts that are here after named or to take effect. I give unto my beloved wife the plantation whereon I now live, with all horses, cattle, hogs, household & kitchen furniture, tools & the following Negroes, viz: Mingo, Jann & their two children Aleck & Eliza, Betty, Ezekiel, Harriet, Hannah & Isaac during her natural life & at her & at her death to be divided among my children that may be then living. I desire my wife to select three disinterested persons to value & divide the said Negroes into lots for my five youngest children, viz: Thomas, Robert, James, Malichn (Malachi?) & Elizabeth as they arrive at the age of twenty-one years or marry. This to make them equal with my children that has (have) already received, viz: Phillip,William, John and Nancy. I desire that all the property not bequeathed to a child to be keep (kept) and used for the raising & schooling my youngest children. But when the youngest child come of age or marry I desire my executors to sell my two tracts of land one on Cloud Creek & the other on Turkey Creek called the Singleton Tract and the money equally divided so all my children to be made equal. Joseph married Elizabeth Raiford DANIEL, a daughter of John DANIEL and Martha Pearson COOK of Hancock County, in 1827 and came to North Georgia in 1830-1836, where he bought a large tract of land in Cherokee, later Walker County, Georgia. His old home still stands in Chattanooga Valley near the village of Flintstone. Joseph P. McCULLOUGH [sic] is named in the History of Walker County as one of the original settlers of Chattanooga Valley, along with B. McCUTCHINS and James PARK, some of whose children would later marry into Joseph and Elizabeth McCULLOH's family.
Joseph was one of the Commissioners of Georgia for the removal of the Indians from this section, and a successful planter. At one time he ventured into the silk business, planting a considerable acreage in mulberry trees and importing silk worms and machinery for weaving silk. This was no doubt the first plant for weaving dress materials in North Georgia, but it was not profitable.
Joseph and Elizabeth had nine children, a son and eight daughters. His interest in their education made him a promoter of one of the earliest schools in this section, the Aderhoff School on Lookout Mountain.
Joseph and Elizabeth's children were: Caroline, who married Thomas Yandell PARK; Juliet A., who married Dr. Ira William McCUTCHEN; Katherine, who married William BRANHAM; Martha Cook, who married I. P. RUSSELL; John, who married Jane BENNETT; Sarah Geraldine, who married Wyatt Socrates McCUTCHEN; Mary Elizabeth, who married John T. BURKHALTER; Florence, and Johanna.
A Methodist church was built on land donated for that purpose by Mrs. M. E. BURKHALTER. The McCULLOH family cemetery is next to this picturesque stone church. As of the printing of The History of Walker County, Georgia, many descendants of Joseph and Elizabeth McCULLOH still live in this area." [History of Walker County, Georgia]
In the will of Elizabeth's father, John DANIEL, he names none of his family, putting everything he owns into a single economic engine for the benefit of his entire family. He names his cousin and stepson, James L. DANIEL, as his executor and administrator of his will. Then in the records of Hancock County, "James L. DANIEL, nominated executor or the last will and testament of John DANIEL, decd appeared personally in court and was duly qualified as executor of said will and thereupon letters testamentary were issued to him in the premises. On application of James L. DANIEL, executor of John DANIEL, decd, it is ordered that George RIVER, Aaron SMITH, John HUBERT, Joseph P. McCULLOH, and Thomas W. BURTON be and they are hereby appointed appraisers of the personal property of the said decd, and that they or any three or more of them after being duly sworn, do appraise said property and deliver the appraisement thereof to said executor."

There were 600 farms and one manufacturing establishment with a real estate value of $923,600 and personal estates totaling $1, 007,725.

Elizabeth Raiford DANIEL's father, John DANIEL wrote what might be termed an all inclusive will. He gave no individual bequeaths, but instead, left everything to be operated as a whole for the benefit of all his family, eventually to be equally divided among his children. In part, John wrote, "It is my will and desire that all the Negroes of which I may be possessed, together with every other species of personal property should be kept together upon my two plantations, vis, the plantation on which I now live, and ___ Mill (?) place for the natural benefit of my wife and children,... when my wife marries or any of my children arrive at the age of twenty one years or marry, they or either of them upon the happening of such event shall be entitled a distributive share of my whole personal estate , and should it suit the convenience of my children after receiving a share of my personal estate as above mentioned, shall be at liberty to work their hands on any part of my lands, rent free."
At the age of 16, Elizabeth Raiford DANIEL married Joseph Portlock McCULLOH, son of John McCULLOH, RS, and Nancy BUTT, on 17 Mar 1829 in Walker County, Georgia. Joseph and Elizabeth had nine children: Katherine, Johanna, Caroline Virginia, Juliet Alice, Martha "Mattie" E., John A., Sarah Geraldine, Mary Elizabeth, and Florence.
Information found on a headstone in the McCULLOH family cemetery, located eight miles south of Chattanooga, Tennessee at Flintstone, Georgia Methodist Church indicates that E. R. (Elizabeth Raiford) McCULLOH died on Aug 10, 1871.

Wayne NEIGHBORS, 80, of Hogansville died Monday at Wellstar Cobb Hospital in Austell.
Mr. NEIGHBORS, born March 11, 1922, in Heard County, was the son of the late Lonnie and Berta Eley NEIGHBORS. He had lived in Hogansville since 1925 and was an Army veteran of World War II, having received the Purple Heart. He retired as a rural mail carrier for the Hogansville Post Office, was a member and deacon of First Baptist church of Hogansville and was a member of Hogansville Masonic Lodge #93 Free and Accepted Masons.
Survivors include his wife, Estelle NEIGHBORS of Hogansville; a daughter and son-in-law, Jackie and Michael VILLANI of Dallas; a son Ron NEIGHBORS of son (sic) Francisco, Calif.; two stepsons and a spouse, John LANCASTER of Hogansville and Burl and Louise LANCASTER of LaGrange; a sister and brother-in-law, Corene and Charles MORRISON of Smyrna; granddaughter and her husband, Michelle and Jeff HARMAN of Douglasville; great granddaughters, Zoe Harman and Sophie HARMAN; step grandchildren, A.J. LANCASTER, Joe LANCASTER, Jerry LANCASTER, Gerald LANCASTER, Kelly BRASHER and Amy THOMPSON; and several step great-grandchildren.
Funeral services will be at 2 p.m. Thursday in the chapel of Claude A. McKibben and Sons Funeral Home in Hogansville with the Revs. Harold Willis and Carl Knowles officiating. Burial will be in Myrtle Hill Cemetery in Hogansville with Masonic rites.
The family will receive friends at the funeral home this evening from 6 until 9.

Obituary:
Funeral services were held Tuesday at Capps Memorial Chapel in Fairfield for June Gehrels Daniel, 82, of Freestone county, who died Feb. 5 in Palestine. Interment followed at Dew Cemetery.
Mrs. Daniels was born June 11, 1928 in Winters to Walter William and Daisy Smith Gehrels.
She was a graduate of Teague high school and married Finis Daniel on June 20, 1949 in Dew and was a charter member of the Ladies Auxiliary of Wilbur H. Bailey Post #5872 V.F.W. in Fairfield.
Mrs. Daniels was preceded in death by her husband on Feb. 16, 1997. She is survived by children Darlene Smith and husband Wayne of Palestine and Dannie Daniel of Fairfield; sisters Neville Bosley of Houston and Shirley Free husband Wayne of Southlake; grandchildren Sarah Daniel and David Daniel of Austin; one great-grandson and numerous nieces and nephews.
Officiating services was Apostle Travis N. (Bo) Davis. Pallbearers were Jerry Bosley, Tommie Bosley, Joe Chandler, Bucky Zehm, Robert Zehm, and John Daniel Chandler. Making arrangements was Capps Memorial Chapel of Fairfield.

Mr. Garnett DANIEL - "Mr. Garnett DANIEL, 93, of Hogansville, died Saturday, January 18, 1997, at the West Georgia Medical Center in LaGrange. The funeral service was conducted Monday afternoon, January 20, in the Chapel of the Claude A. McKibben and Sons Funeral Home. The Reverend Marty FEW and Reverend R.C. PRESCOTT officiated and interment was in Emmaus Primitive Baptist Church Cemetery in Hogansville. Pallbearers were Ronnie DANIEL, Jerry DANIEL, Vance BEAL, Jeffery DANIEL, David DANIEL and Darrell DANIEL. Mr. DANIEL was born November 11, 1903, in Troup County, son of the late Jim and Ida Denney DANIEL. He lived at Hogansville most of his life, was a member of Antioch Baptist Church, and was retired from Uniroyal, Inc. "Harrit DENNIS", is named as a daughter in the May 1832 Will of her father, David DANIEL. Harriet E. DANIEL married Rueben DENNIS. Census records indicate that she and Reuben had two sons and two daughters. Her son, John L. DENNIS, is the only one whose name is known to this compiler.
In 1880, Harriet was head of household, widowed, and living with her son, John, who apparently never married.

Herman Daniel, 72, was to be buried at Emmett Saturday afternoon at 2:30 following funeral rites at Corsicana. He died Friday. The Rev. Wesley Howard Jr. officiated.
Daniel was a long-time resident of Frost and a retired farmer, native to Fairfield.
Survivors include a son, McAfee Daniel of Corsicana, a daughter, Mrs. Sue Allison of Dallas; two grandchildren; seven brothers, all of Fairfield, Elbert Daniel, Leon Daniel, Frank Daniel, Finis Daniel, Wesley Daniel, Wordlow Daniel and Lewis Daniel; and two sisters, Mrs. Blanche Peyton of Fairfield and Mrs. Evelyn McClure of California.
Pallbearers to be Chester Lewis, Clark Putman, Martin Thompson, Robert Sam Thompson, Joe Sheppard, and Marvin Burns.

Mrs. Daniel Dies Tuesday
Mrs. Ollie Daniel, 76, Emmett and native of Rice, died Tuesday in Memorial Hospital. She was a retired school teacher and a member of the Methodist Church.
Funeral services will be held Thursday at 4 p.m. at the Emmett Baptist Church with Dr. H. Lively Brown of First Methodist Church here officiating. Burial will be in the Emmett Cemetery. Corley Funeral Home is in charge of the arrangements.
She is survived by her husband; one son, McAfee Daniel of Corsicana; one daughter, Mrs. Sue Allison of Dallas; two grandchildren; one brother, Rufus McAfee of Hillsboro; two sisters, Mrs. Mattie Fagalo of Blooming Grove and Mrs. Georgia Johnson of Graham; and several nieces and nephews.
Ollie LaVina was a daughter of Hugh Embury and Elizabeth Rice "Bettie" (Groves) McAfee. She married Herman Daniel on 19 November 1926 in Navarro County, Texas
