Levi Lawrence David DANIEL was the seventh child of John DANIEL, son of William DANIEL of Edgefield County, South Carolina, and Martha Pearson COOK, widow of Levi DANIELL of Hancock County, Georgia. L. L. D. married Eleanor ASPINWALL on 8 July 1845. Levi Lawrence was a great grandson of William O'DANIEL of Stafford County, Virginia and grandson of John O'DANIEL of Fairfax County, Virginia.

Levi L. D. DANIEL's father, John DANIEL of Hancock County, wrote what might be termed an all inclusive will. He gave no individual bequeaths, but instead, left everything to be operated as a whole for the benefit of all his family, eventually to be equally divided among his children. In part, John wrote, "It is my will and desire that all the Negroes of which I may be possessed, together with every other species of personal property should be kept together upon my two plantations, vis, the plantation on which I now live, and ___ Mill (?) place for the natural benefit of my wife and children,... when my wife marries or any of my children arrive at the age of twenty one years or marry, they or either of them upon the happening of such event shall be entitled a distributive share of my whole personal estate , and should it suit the convenience of my children after receiving a share of my personal estate as above mentioned, shall be at liberty to work their hands on any part of my lands, rent free."

Levi Lawrence moved to Barbour County, Alabama circa 1835 when his half brother, James Levi DANIELL, also moved there. James was the son of LEVI DANIEL, and grandson of James DANIELL of Fairfield County, South Carolina and Hancock County, Georgia.

Eleanor E. ASPINWALL was a granddaughter of Capt. James BUTTS of Hancock County, so named in his Will. James Levi DANIELL was executor of the Will and in it was given guardianship of Eleanor and $1000 to protect as her legacy. James Levi had married Capt. John BUTTS' daughter, Elizabeth Clements BUTTS, on 3 Dec 1818 in Hancock County, Georgia.

David DANIEL, age 30-40, is listed in the 1840 Hancock County, Georgia Census, Series: M704 R43 Page 215, his household includes two males 5-10, one male 10-15, one male 30-40, one girl under 5, one girl 5-10, one female 15-20, and one female 30-40. He has two free colored females in the household and eight slaves. CAUTION: This may not be Levi Lawrence David DANIEL who was born in 1816 and married Eleanor ASPINWALL in 1845.

John William DANIEL, Levi's brother, wrote his Last Will & Testament on 22 September 1841, recorded in Barbour County, Alabama Orphans Book 2, p. 151. John's only beaqueath was "It is my will and desire after all my Lawful debts are paid that all the property in which I am or interested personal or real in the Estate of my Father, John DANIEL, deceased, and my Brother, Benjamin F. DANIEL, deceased, And all the Negroes, Lands, Horses and Stock that I own and all of every discription, I give and bequeath to my brother, Levi L. DANIEL, his Heirs and Assigns forever." Signed: John W. DANIEL. Test. Arthur I. BUTTS Georgia D. BUTTS A. C. MITCHELL Thos. _. SANFORD" The Will was recorded in Barbour County, Alabama "cir. 1844."

On 23 May 1846, Levi L. DANIEL and his sister-in-law, Eliza C. DANIEL, signed as bondsmen for William A. ANDREWS and Jesse SLACK as administrators of the estate of Archibald C. SLACK. [OCR Book II, page 44 p. 262]

Eleanor "Ellen" Elizabeth ASPINWALL was born before 2 July 1826, the date of her mother's death. Her mother was about twenty years old when she died soon after Eleanor's birth.

Eleanor is named in the 6 February 1835 Will of her grandfather Capt. James BUTTS: "I give and bequeath to James L. Daniel in trust to and for the use of my granddaughter Eleanor Aspinwall the sum of one thousand dollars provided however that the said James L. Daniel is expected to use said thousand dollars in such manner as may be conceived most conducive to the interest of the said Eleanor during her minority or remaining unmarried to be at liberty to apply any part of the profits of said one thousand dollars to the benefit of the said Eleanor when the said Eleanor shall arrive at lawful age or marry it is my wish and desire that said money should be laid out in such property as the said Eleanor shall direct which property so purchased I give and bequeath to the said Eleanor during her natural life to be held by her free of the control of her husband and to her sole and separate use after her death to her children in fee simple. But in the event that the said Eleanor should die before she marries or arrives at lawful age it is my will and desire that said money should be returned back into my estate to be disposed of as hereinafter expressed."

Ellen married Levi Lawrence David DANIEL, half-brother of James Levi DANIELL.

Obituary: A GOOD WOMAN GONE TO HER REWARD. Mrs. T. A. Aston departed this life on the 15th day of February, 1930, at the ripe old age of 70 years and 24 days. Mary Jane Gilley was born in Bosque county, Texas, on the 22nd day of January, 1860. She professed religion and united with the Methodist church at the age of 14 years and ever after lived a devoted Christian life until her Maker called her to her reward, always being an humble and consecrated follower of the Saviour whom she professed—a living, walking example of the mother in Israel that she was. She was married to T. A. Aston on December 25th, 1877 near the town of Kerens, Navarro county, Texas. To this union were, born nine children, four of whom are still living, Mrs. Letha Britton of Corsicana, Texas, Rice K. Aston of Chatfield, Texas, Mrs. Albert Ashton of Waxahachie, Texas, with whom she spent her last days, and Mrs. Floyd Herrin of Italy, Texas. Mrs. Aston was confined to her bed for several months before her passing on, and during this time her suffering was intense, but through it all she was watched over and ministered to by the loving hands of her devoted children. Through this trying ordeal they did everything within human power to comfort and soothe the declining body, prompted by the love they had for that one whose love and anxiety for her own, knew no bounds. And that soul mate who had walked down the pathway of life, side by side, hand in hand with her for more than fifty years, was ever at her side, showing in every word and act that the love of his young manhood had grown in intensity until she was his only thought and her presence was his greatest consolation. She was conscious to the last and at all times declared her preparedness to meet her Savior on the shore of sweet deliverance where peace is eternal and suffering is unknown. The body was accompanied to Frost, Texas, where it was tenderly laid to rest in the presence of a host of neighbors among whom she had lived for 46 years. The floral tribute was very beautiful, showing the love and respect they had for their departed neighbor, whose memory they will ever cherish. A FRIEND.

General Notes: Husband - John Craig BROWDER, USA, WWII

Obituary: John Craig Browder departed this life on April 2, 2006. A native of San Jacinto County, he was a longtime resident of Houston and, since 1988, lived in retirement in his hometown of Coldspring. Craig was the third child of Jim and Mildred Leslie Browder, who preceded him in death, as did a brother who died in childhood. He received his schooling in Coldspring, served in the United States Army in the European theater during World War II, and did college work at several institutions. He was one of the first "campus boys" who were permitted to take classes at the Mary Hardin-Baylor College, which then restricted its enrollment to women, and while attending the University of Texas at Austin he worked as a house parent at the Texas School for the Deaf, where he mastered sign language, a skill he kept throughout his life. He took additional classes at Sam Houston State University before graduating from the University of Houston in 1950. He went to work for Robertson Tank Lines, advancing to the post of traffic manager, remaining with the company until his retirement. Craig married Wilma Jean Atkins in 1947. This union produced four daughters, Gwen Richardson of Athens, Sally Browder of Batesville, Arkansas, Jeanine Johnson of Arlington, and Peggy Collins of Tomball, ten grandchildren, and four great grandchildren. All survive him, as do his brother and sister, James Leslie Browder of Waverly and Sally Browder Atkins of Coldspring, and a host of cousins and nieces and nephews. He was a deacon at Willow Meadows Baptist Church in Houston and at First Baptist in Coldspring, a volunteer at Care/Share of San Jacinto County, a member of the Senior Citizen Center of Coldspring Board of Directors, and an active member of the Coldspring Lions Club. He was quick to offer help whenever it was needed and just as quick to avoid calling attention to himself for helping. While his wife Wilma was church missionary at Willow Meadows Baptist he went with her on visits, showing great compassion and a remarkable ability to remember the names and circumstances of vast numbers of people who needed the kindness of the church. They made a great team in that work as in so much else. Craig created delight everywhere he went. He was unfailingly kind and cheerful. He had a legion of friends who always welcomed his arrival and were always welcomed by him. He loved spending time with his family and friends, fishing with his grandkids, playing golf, cards, and games of all kinds, and rooting for the many sports teams that received his allegiance. Some of his friends kidded him that he went to so many colleges because he knew some of them had to be winning at something. No one laughed at such jokes harder than Craig, who was secure in who he was and how much he was loved. He will be greatly missed. Funeral arrangements are in the care of Pace-Stancil, Coldspring. JAMES D. ATKINSON
With a comprehensive knowledge of the fundamental principles of jurisprudence, James D. Atkinson was well qualified for the office of clerk of the circuit court of Greenup county, which he acceptably filled for two years, and has been engaged in the practice of law since January 1, 1927. He also has to his credit an exceptionally fine military record.
Mr. Atkinson was born January 17, 1899, in Stanton, Powell county, Kentucky, and is a son of John D. and Lucy (Donaldson) Atkinson, natives of Bath county, this state. His ancestors in the paternal line were among the early settlers of eastern Kentucky and it is stated in the records of Bath county that Thomas Atkinson, of Culpeper county, Virginia, lived in Salt Lick, Kentucky, in 1797. His wife was Mary Ann Cracraft, of Redstone, Pennsylvania, and they had two sons, John and William Sanford. The latter married Nancy Coshow, a native of Bath county. Their son, William Franklin, married Miranda Donaldson, and they were the parents of John D. Atkinson, a successful attorney, who for forty years has practiced in Stanton and is an able and highly respected exponent of his profession.
James D. Atkinson attended the public schools of his native town and Stanton Academy. He was next a student at the University of Kentucky, from which he received the degree of LL. B. in 1924, and in the same year was admitted to the bar. He was appointed circuit clerk in August, 1924, and measured up in full to its requirements, performing his work with thoroughness and efficiency. He gives his political allegiance to the democratic party and is identified with the Masonic order. He also belongs to the State Bar Association and the Sigma Nu college fraternity.
On April 17, 1917, Mr. Atkinson enlisted in the United States army, becoming a member of Company A, First Battalion of the Twenty-sixth Infantry, attached to the First Division, and was sent to San Benito, Texas. In June, 1917, he was ordered overseas and was stationed in various offensive and defensive sectors on the western front. He participated in the Soissons, Cantigny, St. Mihiel, Meuse-Argonne and Montdidier offensives and in the first mentioned battle was wounded July 20, 1918. He landed in the United States on his return on June 3, 1919, and was honorably discharged as a private of the first class. When in the field Mr. Atkinson's post was that of a liaison man, or runner, bearing verbal messages to maintain communication between his company and other units. This is a very vital service and particularly hazardous for the reason that one fights in the front line until needed and then carries his messages over open ground where he is usually the only target exposed to enemy fire. A liaison man is usually needed only when a stiff resistance is encountered and help is required. They wear a red band on their arm, making them conspicuous, and the Germans were very anxious to stop them and did quite often. He was an exemplary soldier, displaying notable coolness and bravery under the terrible ordeals to which he was subjected, and his victory medal has five battle clasps for major offenses in which he participated.
Mr. Atkinson was married June 30, 1925, to Miss Frances Halbert, a daughter of William C. and Fanny (Bate) Halbert, of Vanceburg, Kentucky, the former of whom is circuit judge of the twentieth judicial district. Mr. and Mrs. Atkinson have become the parents of a son, James D., Jr., who was born June 29, 1926.

Americus MITCHELL, b. 23 Dec 1870, in Glennville, Russell County, Alabama, attended college at Auburn, Alabama and then went to the U.S. Military Academy at West Point, New York, graduating in 1895.

"Lieutenant Americus Mitchell, who recently graduated from the United States Military Academy at West Point, N. Y., arrived in the city Saturday night and will spend the summer at the residence of his mother, Mrs. James B. Mitchell, 208 Eleventh street." [The Columbus Enquirer-Sun, 18 June 1895]

He took part in the Spanish-American War, but did not arrive in Cuba until the fighting was over. While at Santiago, Cuba, he contracted yellow fever, but overcame the disease. He remained in the Army, rising to the rank of Colonel and fighting in World War One with the 89th and 35th Divisions and participating in the St. Miheil and Meuse Argonne campaigns.

Obituary: Douglas Warner Jr., a retired physics professor and longtime Roland Park resident, died Monday of progressive aphasia at the Broadmead retirement community in Cockeysville. He was 84. Dr. Warner, whose parents owned and operated the O.F.H. Warner Paper Co., was born in Baltimore and raised on Lombardy Place in Roland Park. He was also a grandson of Dr. Howard A. Kelly, one of the four founding physicians of Johns Hopkins Hospital. He attended Gilman School and graduated in 1943 from the Pomfret School in Pomfret, Conn. He joined the Navy at the end of World War II and attended the Navy's V-12 program at Brown University; he then transferred to the Massachusetts Institute of Technology, where he earned a bachelor's degree in 1948 in physics. He went to work at the Johns Hopkins University's Barton Laboratory and earned a doctorate in quantum mechanics from Hopkins in 1962. In 1972, Dr. Warner left Hopkins and joined the faculty of Essex Community College, where he taught physics until retiring in 1993. An outdoorsman and a nature preservationist, Dr. Warner was one of the founders of the Chesapeake Bay Foundation. He enjoyed fly fishing on the Gunpowder River and hunting with Labrador retrievers he trained. He also spent summers at his cabin on Ahmic Lake in Ontario. Dr. Warner, who had lived at Broadmead since 2005, was a member of Brown Memorial Presbyterian Church, 1316 Park Ave., where funeral services will be held at 3 p.m. Sunday. Surviving are his wife of 59 years, the former Nancy Atkinson; a son, Douglas Warner III of Hebron, Ky.; two daughters, Frances Warner of Baltimore and Margaret Kelly Warner-Rosen of Toronto; and four grandchildren. Lena DANIEL, born 6 August 1882, was the daughter of John A. and Sarah J. DANIEL. In the 1900 census, Lena was 16 and single in her parents' home, her birth listed as August 1883.

She married D. J. "Jep" BRAND on 6 June 1901 in Heard County, Georgia. Lena and Jep had four children before the 1910 census when she is 27 and a "widow" with four children living in her father's home. Family recollections say that Lena had divorced D. J. BRAND.

In the 1910 census listing for John A. DANIEL's family, everyone was listed as DANIEL, despite some being widowed, married, or named as grandchildren, making identification of individuals difficult at best. Both Lena and her sister Mattie are in their parents' home in 1910. Both have children, Lena four and Mattie has had 2, one living. Five apparent grandchildren are in the home. Descending in age, they are Mattie Lou 5, Golden 5, Sarah Lee 3, Jep 2, and Ruthie J. (less than a year). Sarah Lee is known to be the daughter of Mattie. Jep and Ruthie are known to be to be Lena's by Jep BRAND. Lena and Jep's two older children Katie and Maude live with their father. The parents of Mattie L. and Golden are not proven.

An Unknown AUSTON, AUSTIN, or OSTEN/OSTEEN was the husband of "Betty AUSTON" named in James DANIELL's Bible as mother of "my grandson Jesse Daniell AUSTON." No other information on Betty or her husband has yet been found. They are thought to have died before May 1797 when Betty's father wrote his LW&T. Unlike James' other children or their spouses, neither received a bequeath. Jesse, born 9 September 1794, is named as an AUSTIN per his Uncle Levi's Bible and in the 1807 record of his official name change to Jesse DANIELL. In Levi's estate records, Jesse is once named as OSTEN. The 1850 census shows Jesse was born in Georgia.

Possible family?
The 1798 Georgia Tax List names Wm J(?) ASTEN and Robt ASTEN in Capt E. D. KING's District, Greene County and Robert ASTIN 150 acres and Wm. L. (misread S.?) ASTIN 157 in Capt. Wm S. ASTINs District, Greene County.

Betty DANIELL is named in the 1797 Last Will & Testament of James DANIELL of Hancock County, Georgia in a bequeath to "my grandson Jesse Daniell AUSTON, son of Betty AUSTON." Betty is not named in transcriptions of James' Bible, but there are no Bible entries after 1765. Her mother and her date of birth are not known. No other record concerning Betty or her AUSTON husband has been found.

Betty and her AUSTON husband are thought to have died before 1797 because James did not make a bequeath to either in his Will, and, after 1800, Jesse AUSTON is supported by payments from the estate of his uncle Levi DANIELL.

Might this story be part of the answer to what happened to Betty and her AUSTON husband and how Jesse Daniell AUSTIN was orphaned?
In the "History of Hancock County, Georgia", Fannie Phillips MITCHELL contributed the DANIELL family information. In it, she relates the story that Jesse DANIELL may have been killed by either Indians or the British. "When I was quite a small child my great-grandmother used to tell a story of an attack by Indians (I believe) and how some of the children were saved by an old Negro nurse who hid them in a depression in the ground overgrown by weeds. I have a rather hazy notion as to who these people were, but I know they were my great-grandmother's close kin, and I remember the story very distinctly." DISCUSSION: ASSIGNMENTS AND RATIONALE:
As of 25 August 2010, this compiler has chosen to assign Betty as an unrecorded daughter of James and his unknown first wife. She may be Elizabeth "Betty"
There are at least three possibilities for who Betty DANIELL was. (2) She may be Martha Elizabeth "Betty." There is record to support the assignment of "Betty AUSTON" as Martha Elizabeth. Although named in James' Bible, no additional information about her has been found. I believe it necessary for both Martha and Betty to be individually named in the family file.
(3) She may be a daughter by James' second wife and widow, Nancy HARDWICK, but there is only 1 female in James household in the 1790 census.

Although listed in a transcription of Levi DANIELL's bible, there were no children named James Daniell AUSTIN and Caty Daniell AUSTIN. They are not children of Betty Daniell AUSTON. The AUSTIN surname was inadvertantly assigned to Levi DANIELL's children. In explanation: "James Daniell AUSTIN" was born before his grandfather, James DANIELL, wrote his will and was not mentioned as a grandson as was Jesse Daniell Auston. James' and Caty's birth dates match the names and birth dates of Levi DANIELL's children, James Levi and Catherine B. Both James Levi and Catherine were named as children in Levi's Will.

Obituary:
PINEWOOD [South Carolina] - Eugene Belton "Gene" McLeod, Sr., 84, husband of Nancy Evans McLeod died Wednesday March 31, 2004 at his home. Born in Clarendon County he was the son of the late Jacob Lawson McLeod and Elizabeth Beard McLeod. Mr. McLeod was twice married, first to the late Sadie Fair Aycock McLeod then to Nancy Evans McLeod.
Mr. McLeod was a member of Pinewood United Methodist Church where he served as a member of the church council for many years in various positions. Mr. McLeod was educated in Manning public schools and was a commissioned officer in the U.S. Army during World War II, serving in the European Theater of Operations earning the rank of Major.
After the war, he settled in the Pinewood area where he farmed and owned and operated a dairy and cotton gin. He was a founder of Sumter Dairies, Excello Mills and Ag-Rotor. He was also a founder and major stockholder in Young's Food Stores. One of his greatest loves and lifelong endeavor was serving as a member of the Natural Resources Conservation Service Commission for 50 years where he led the restoration project for Pocotaligo Swamp. Honors include the South Carolina Outstanding Conservation District Commissioner Award and the Order of the Palmetto, the highest award given by the Governor of South Carolina. Surviving are his wife of Pinewood; his children by his first marriage, Cecilia Fair Edmunds and husband, Richard Champion Edmunds of Wedgefield, Helen M. Lee and husband Wedrell Wayne Lee, Sr., Eugene Belton (Mac) McLeod, Jr. and wife Joan Simms McLeod, Robert Kenny McLeod and wife Cindy Lee McLeod, Walter Pinckney McLeod and wife Tammy Fenters McLeod all of Pinewood; 23 grandchildren, 17 great-grandchildren. Step-children, Carol Bond and husband Mike Bond, Kay Nobles and Phil Nobles all of Sumter, Kenneth Evans and wife, Yvonne Evans of Lynchburg and Janice Hawkins and husband Bob Hawkins of Chesapeake, VA; 11 step-grandchildren.
Funeral services will be held at 4 PM Friday at Pinewood United Methodist Church with the Rev. Richard Broomall officiating. Burial will follow in the Pinewood Cemetery. [The State, Columbia, South Carolina, Thursday, April 1, 2004.]

SENATOR THOMAS RAYSOR, "born 23 December 1797, was the son of Michael RAYSOR, Jr. and Eleanor RISHER. A planter, he initially resided in St. Bartholomew Parish. Tax returns for 1824 recorded 1,121 acres and 12 slaves as his property. The 1830 federal census noted 33 slaves as part of his St. Bartholomew household. Sometime before 1841, he moved to Barnwell District.
According to the 1850 census, his real estate in Barnwell was worth $6,000; slave schedules for that year recorded 147 slaves as belonging to him. Writing his will 23 September 1856, he mentioned a plantation (2,730 acres) and other property; an inventory taken 2 February 1858 included 48 slaves and valued his estate at over $20,000.
Public office for RAYSOR began with his service as clerk of the Court of General Sessions and Common Pleas for Colleton District (1822-1833). While in the Senate, he was a member of the committees on engrossed bills (1833), internal improvements (1833), and finance (1833). Locally, he served as inspector of timber for the western division of the Charleston and Hamburg Railroad (1832-1833) and militia captain (c. 1841).
Married twice, Raysor first wed Hannah STOKES, daughter of Peter STOKES and Elizabeth LAWFORD. Six children were born to them: Elizabeth Eleanor (m. John MAY), Thomas , Jr. (1827-1896), Rebecca Caroline (M. William C. MOSS), Peter Andrew, Laura Anne (m. James Daniel ERWIN), and James William. His first wife died 21 February 1841. In May 1844 he married Mary AYER, daughter of Lewis Malone AYER and Sarah NUNNARS and widow of William DICKS. No issue was born to the second union. Survived by his wife and four children, Thomas RAYSOR died 11 January 1858 in Barnwell District." from the Biographical Directory of the South Carolina Senate, 1776-1985, Volume II, by N. The earliest known ancestors of Senator Thomas RAYSOR's father, Michael RAYSOR, Jr, were first noted in New Bern, North Carolina in the mid 1700's. The Rishers, Fontaines, and Raysors (also spelled Rasher, Raisher, Razor, and Razer in early ) were all present in that area at the time and later migrated to Colleton District, South Carolina.
Michael RAYSOR married Eleanor RISHER around 1795, and Thomas RAYSOR was the second of their seven children. According to Frank W. RAYSOR, family legend has it that Eleanor's parents, Benjamin RISHER and Mary Fontaine RISHER, objected to the marriage because Michael operated a stage coach stop where whiskey was sold. The Raysor Tavern is shown on the 1824 map of the area, on what is now SC 61."
