General Notes: Husband -

James SHIRLEY was born February 24, 1768 in Frederick County, Virginia, and died January 16, 1840 in Charles Town, Jefferson County, West Virginia. He married (1) Ruth HIATT March 05, 1793 in Berkeley County, (West) Virginia, daughter of John HIATT. She was born April 30, 1756, and died April 1817 in Charles Town, (West) Virginia. He married (2) Matilda VINSON December 26, 1821 in Frederick County, Virginia. She was born 1795 in Montgomery County, Maryland, and died September 17, 1855 in Jefferson County (West) Virginia.
James SHIRLEY's Will is recorded in Jefferson County, West Virginia, Will Book 9, Page 409. In it he gives his wife Matilda one third of his estate "both real and personal," stipulating that after her death her Dower was then to be equally divided between his sons Robert, George William, and Thomas Lee. The remaining two thirds of his holdings were distributed to sons Robert, George and Thomas. At his death James SHIRLEY owned numerous tracts of land amounting to considerable acreage. A Plat of some of James' extensive holdings may be found in Will Book Book 24, Page 309, of Jefferson County. James gave his sons several slaves by name. All other slaves not named in the Will were to be equally divided among them (in an estate accounting all are named). James did will that "my yellow boy named James RUST shall be free at the age of twenty one years at which time my executor hereafter named shall out of my estate furnish him with two good suits of clothes of good quality, and twenty five dollars in cash." In the accounting of the estate the cost of Mr. Rust's two suits of clothing came to $57.54 (W.B. 10, p. 11). To his daughter, Mary HURST, he gave "two Negroes by name Jerry and Lucy," and $1,000.00 cash.

Obituary: Albert Frank Hibbs, Jr. of Dallas died Sunday, July 19, 2009 .
Mr. Hibbs is survived by Dorothy, wife of 68 years, children Jerry & Cathy Hibbs of Holly Lake Ranch, Judy & Bill Daniel of Fairfield, and Janet & Bob Vela of Arlington, TX, eight grandchildren, 11 greatgrandchildren, numerous nieces & nephews, a sisterin law Gloria & Merle Debus of California, and many wonderful friends. Mr. Hibbs was a charter member and deacon of Royal Haven Baptist Church, WWII Veteran, 50 year Mason, wonderful husband, father, grandparent & great-grandparent. Visitation will be at Rhoton Funeral Home,Carrollton, Thursday, July 23, 6-8p.m. Memorial services will be held Friday at 11:30 AM at Royal Haven Baptist Church, 10919 Royal Haven Lane, Dallas, 75229. The family requests no flowers. Rather, send a memorial contribution to the above mentioned church. The family wishes to thank each and every one who has prayed for Al and the family these last several weeks.

William, the son, died 2 September 1922 in Atlanta, Fulton County, Georgia at age 2 years, 10 months. A month later, William and Mary's unnamed son died on 5 October 1922 at age 1 day. Their son, Elmer, was born about 1924. On 24 April 1925, they lost another infant son who lived only one hour and 30 minutes.

Neither Mary or William HIGHT have been found in records after 1925. In 1930, their three youngest surviving children, claud, Frances Louise, and Elmer, resided with their maternal grandparents, Joseph A. SWANGER and Clarrissa L. BALLEU.

To son Abraham land on north side of Long creek. To sons Theophilus and Noah 200 acres of south side of Broad river, and 460 acres on Appalatchee river in Greene Co. To son Wylie another part of land willed to wife and son Henry. To son Thomas remainder of land on Long creek, after the death of my wife, including four acres used as plant beds. To son Myles slaves, etc., at majority. To dau. Mary slaves, etc. To grandson Henry Blake, cattle. To grandaughter Mary Blake, cattle. To grandson John Pope, cattle. Joshua HILL's Congressional Biography is as follws:
HILL, Joshua, a Representative and a Senator from Georgia; born in Abbeville District, S.C., January 10, 1812; attended the common schools and was privately tutored; studied law; was admitted to the bar and commenced practice in Monticello, Jasper County, Ga.; elected by the American Party to the Thirty-fifth and Thirty-sixth Congresses and served from March 4, 1857, to January 23, 1861, when he resigned; unsuccessful candidate for Governor in 1863; appointed collector of customs at Savannah in 1866 and register in bankruptcy in 1867 but declined both offices; was elected as a Republican to the United States Senate on July 28, 1868, took the oath of office on February 1, 1871, after Georgia's readmission to representatation in Congress, and served until March 3, 1873; was not a candidate for reelection; returned to Madison, Ga., and resumed the practice of law; member of the State constitutional convention in 1877; died in Madison, Ga., March 6, 1891; interment in Madison Cemetery.

Huldah HILL's brother was the Hon. Joshua HILL, Jr., Esq. of Madison, Morgan County, GA and he married Emily REID of the REIDS of Morgan and Putnam County, GA. Congressman Joshua HILL, Jr. (1812-1891) of Madison, GA, brother of the Hulda HILL who married that John DANIEL, was an avid opponent of the South's entering the CW and was good friends with SHERMAN's step-brother, John, also then a congressman from Ohio, as I remember. HILL also did not serve in a CSA unit, either, deciding to stay at home in Madison throughout the war, although I know his son served and was killed at the Battle of Kennesaw Mountain, GA in 1864. I, Lodowick M. HILL of said County, being of sound & disposing mind and memory, do make this my last Will and Testament hereby revoking all of Wills heretofore made by me.
Item 1st. I desire that my body shall be decently buried.
" 2nd. I desire that all my just debts shall be paid.
" 3rd. I bequeath to my beloved Wife Martha S. HILL Forty Thousand dollars; and I direct my Executors hereinafter named to turn over to my wife said Amount either in Money or in Securities to be Selected by her.
4th. I desire that my children or legal heirs be made equal in Advancements, Some having had more than others. The advancements Made to each one of the Children are entered & Charged against them in My large Ledger; the Slaves given before they were set free I have erased as these items are not to be Counted as Advancements. The valuation that I have put upon Said Advancements in Said Ledger is fixed by me & is a part of this my will.
5th. My Taylor plantation in Oglethorpe County, Ga., Containing 2700 Acres More or Less, on the West Side of Long Creek, I will to my Sons Walton P. HILL and Burwell P. HILL to be divided equally between them: valued to them at $5,000 each which will be charged to them in my Ledger with their other advancements, as so much advanced.
6th. I will to my Son Duncan C. HILL my home place & plantation Containing about 4000 acres of Land, on the East Side of Long Creek, mostly in Wilkes County, Ga., & partly in Oglethorpe County, Ga., which tract of land I deeded to Said Duncan C. HILL to be his at my death: Said tract of land being given as an advancement and charged to him in My Ledger at the sum of $13000 (Thirteen thousand dollars).
7th. I desire & Will that all my property not already advanced to my children be collected and divided according to law between my legal heirs (except my wife whom I have already provided for in Item 3rd of this my will) believing that the law makes the best division of An Estate between the heirs at law.
I appoint William W. HILL, Duncan C. HILL, and Abner Welborn HILL my Executors to execute this my last Will.

HILL I therefore make and publish this codicil to Said Will.
1st. I revoke and annul the bequest in My Said Will to my Son B. P. HILL as One of my heirs at law — and I will & devise Said portion that I intended for Said B. P. HILL to my Grandson L. Harry HILL. That is to say, I bequeath to L. Harry HILL that portion (which is a child's part) of my Estate that I intended at one time to leave my Son B. P. HILL. And I will and direct that L. Harry HILL shall stand in the place of his father B. P. HILL both as to receiving a child's portion as aforesaid and as to all advancements made or to be made to B. P. HILL: — Said L. Harry HILL Accounting for all said advancements in the place of B. P. HILL.

POSSIBLE SON:
Col. John Meriwether Hill, 1827- 1894, educated at home school and at the U. of Ga.; had no aspiration for public office, preferring the peace and quietude of home life. He, however, served as Colonel of the 3rd Reg. Ga. State troops, Genl. P. J. Phillips' Brigade, under Major Gen. Gustavus W. Smith, in 1864 ("Avery's His. of the State of Ga.", pp. 284-5), and there is on file in the Adjt. Genl's Office, at the State Capitol, a notification to him of his appointment as Brigadier General of the State Militia. His stature, bearing and commanding person, made him a notable figure in any assembly. He was esteemed, honored and beloved by all who knew him, of unsurpassed popularity in his community and section, and especially was he the friend of, and beloved by the poor, to whom his benefactions were widespread and boundless. He and his younger brother, Burwell Pope Hill, purchased and operated plantations in Dougherty Co., Ga., but sustaining heavy losses in negroes from malaria, sold out there and purchased plantations on White Oak Creek, in Coweta County, Ga.
